A VA contracting officer may use procedures other than competitive procedures to award to a verified veteran-owned small business below the simplified acquisition threshold.
This is VA-specific statutory authority under the Veterans First Contracting Program, separate from the FAR Part 19 set-aside scheme.

VA sole source to an SDVOSB
A VA contracting officer may award a sole source contract where the anticipated award price including options exceeds the simplified acquisition threshold but does not exceed $5,000,000, and the award can be made at a fair and reasonable price.
Requires the firm to be SBA-certified and listed. The certification is the gate, not the capability.
A multi-year training program or a facility-wide millwork program at a VA medical center.

Sole source SDVOSB set-aside, all other agencies
A contracting officer may award a sole source contract to an SDVOSB when only one certified concern can satisfy the requirement, the anticipated award price including options does not exceed $8.5 million for a manufacturing NAICS or $5 million for any other NAICS, and the award can be made at a fair and reasonable price.
NAICS 337212 is a manufacturing code, so millwork requirements carry the higher ceiling.

VA Rule of Two
A VA contracting officer shall restrict competition to veteran-owned small businesses where there is a reasonable expectation that two or more will submit offers and award can be made at a fair and reasonable price offering best value.
The Supreme Court held in Kingdomware that the word shall is mandatory and applies to every VA contract, including orders against the Federal Supply Schedule.
Any unrestricted VA solicitation in a NAICS code listed on this site is a candidate for a written Rule of Two request.

Subcontract and IDIQ team seat
Large primes carry subcontracting plans with small business and SDVOSB targets. A team seat needs no certification to start and converts to a credited SDVOSB seat once VetCert issues.

On the certification gate
Four of the seven routes above require SBA certification under VetCert. That certification is in process and is not claimed here until SBA issues it. Self-certification for SDVOSB set-asides ended on 31 December 2023, and claiming the status before the certificate exists is a False Claims Act problem, not a paperwork problem.
The three routes that are open right now are not consolation prizes. A micro-purchase and a simplified acquisition are how most small firms build the past-performance record that makes the larger awards defensible in the first place.
On the VA specifically
The VA operates under its own statutory scheme at 38 USC 8127, not just FAR Part 19. The Supreme Court held in Kingdomware Technologies v. United States, 579 U.S. 162 (2016), that the Rule of Two in subsection (d) is mandatory and reaches every VA contract, including orders placed against the Federal Supply Schedule.
If your office has an unrestricted VA solicitation in any NAICS code on this site, a written Rule of Two request is appropriate and we will submit one once certified.
